It is entirely up to your chain of command, whether they will allow you to continue collecting BAH or force you back in the barracks.

If your command authorizes single corporals to to collect bah, and you are close, they may allow you to keep drawing bah.

But if it is like most commands that anly authorize single E-5’s to collect BAH, most likely your gonna end up back in the barracks.

2. Go talk to your 1st Sgt, thats what he is there for

One of my husband’s friends from his ship was in your position. He was an E-3 in the Navy and got divorced, and he lost his BAH when the divorce was finalized. And while he was separated, he had to give half of the BAH to his wive, but it was discontinued when they were finally legally divorced. I don’t know if his situation is the be-all end-all rule or not. If you are really concerned about divorce being a possibility for you soon, you may want to talk to a someone in the legal dept as they will probably have experience with this situation. If you find out that you are going to lose your BAH, I wouldn’t sell all of your stuff, though. Just rent a storage unit and keep your things there until you make Corporal and get your single BAH so you won’t have to lose the money that you spent on everything just to buy it back again at full price. Like I said before, my knowledge of this situation comes from one guy’s experience, so this may not turn out to be the case for you, but I hope I helped a bit anyway.

The disposition of your property is decided between you and your soon to be ex-wife if the divorce is uncontested. If you can’t agree, the divorce judge will tell you who gets what including how much of your pay and allowances that she will get for spousal support.

Only E6 and above in the Marine Corps rate BAH w/o dependents. Unless you have special circumstances. Let’s say you get divorced. You will no longer have any dependents (non-member spouse in this case) unless you have children. If you get divorced you will no longer rate BAH.

HOWEVER, even though you will be single and E3 or E4 if you pick up, you may still put a BAH package in through your chain of command. Because you have significant household goods (furniture, appliances, etc.) and rated BAH previously you can put in a BAH package under BAH rule 2 because you rated BAH before.

This package will require 2 endorsements from your chain of command (i.e. company CO and battalion CO) and will then be submitted to your respective base’s area S4 then base billeting before it can be fully approved, but that shouldn’t prevent you from putting the package in. The package shouldn’t take longer than a month to go through if you stay on top of it.

The bottom line is even if you get divorced, you still rate BAH even though you may have to fight for it. Don’t give up.

If your married you automatically rate BAH no matter what your rank. Once your divorce if finalized you won’t rate BAH since you have dependents. if by some chance you continue to receive it after your divorce, [[there are glitches and it happens more then u can imagine]] they’ll find out and take it out of your pay. either way your gonna have to break the lease and go back to the barracks. As to your stuff. idk you could store it or something. Good Luck

If there is room for you in the barracks then you will go back to the barracks and either you sell your stuff or store it at a storage unit, or the wife gets it in the divorce decree.
BAH-diff will start if you have kids, you will be required to pay wife alimony if the divorce says so, but the alimony runs out and then you will be required to maintain military I D cards and keep your kids on DEERs if the divorce decree says that you have to pay for medical and dental.

If you are ordered back into the barracks, the military will store whatever your ex doesn’t get.
